                                        - Reason: High FOIR (Contingent Liability)

1. The Ownership Tag on Credit Reports

When you download your Credit Information Report (CIR) from CIBIL or Experian, examine the Account Details section:

  • Individual: You are the sole primary borrower.
  • Joint: You are a co-borrower sharing primary liability.
  • Guarantor: You have guaranteed another person's debt.
  • While marked as a guarantor, the repayment track record displays the exact monthly Days Past Due (DPD) grid of the primary borrower. If the borrower misses payments for four months, your report displays "120 DPD", identical to a personal default.

2. The FOIR (Fixed Obligation to Income Ratio) Suppression

Even if the primary borrower pays every EMI on time, being a guarantor limits your personal borrowing power:

  • When you apply for your own home loan or commercial vehicle finance, the lender's credit appraisal system reviews all active obligations.
  • Many conservative public and private sector banks treat a guaranteed loan as a contingent financial liability, factoring 20% to 50% of the guaranteed EMI into your monthly debt obligations.
  • This artificially inflates your FOIR, reducing the maximum loan amount the bank will sanction for your own personal needs.

3. The "Settled" Trap on One-Time Settlements (OTS)

If the borrower defaults and you negotiate a One-Time Settlement (OTS) with the bank to stop legal action:

  • If the bank waives any interest or accepts a haircut, the bank reports the account status as "Settled" or "Post-Write-Off Settled" to the credit bureaus.
  • This "Settled" status remains prominently visible on your CIBIL report for seven years, alerting future credit underwriters that you were associated with a distressed credit resolution.
  • To prevent this, negotiate an explicit settlement clause requiring the bank to mark the account as "Closed" or "Discharged upon Full Payment" upon receipt of the agreed sum.

Where it goes wrong

1. Discovering Defaults Years Later

Guarantors are rarely notified by the borrower when business struggles begin. Lenders often wait until the debt has remained in NPA for 12 to 18 months before contacting the guarantor. By that time, the guarantor's credit report shows prolonged default history, their credit score has dropped below 600, and several years of credit standing are compromised.

2. Failure of Bank to Remove Guarantee Tag After Release

A guarantor formally resigns, pays off their portion of the debt, or provides a substitute guarantor, and the bank issues a formal Deed of Release. However, the bank's back-office operations team fails to update the monthly database upload sent to CIBIL. The loan continues to reflect as an active guarantee on the individual's credit report indefinitely until a formal dispute is filed.

3. Identity Theft and Fraudulent Guarantees

Unscrupulous direct selling agents (DSAs) and fintech brokers frequently use KYC documents submitted for personal investments or SIM cards to fraudulently list individuals as guarantors on commercial vehicle or SME loans. The victim only discovers the fraud when their credit card application is unexpectedly rejected.

4. Overlooking Co-Guarantor Contamination

Where multiple promoters execute personal guarantees for an SME facility, one promoter may settle their share of the business, but the credit report reflects the status of the entire loan facility. Until the entire account is closed, the adverse status continues to depress the credit scores of all co-guarantors simultaneously.

What you can do

Active Credit Monitoring Protocol

  • Pull Free Quarterly Credit Reports: Under RBI regulations, every Indian citizen is entitled to one free detailed credit report every calendar year from each of the four credit bureaus. Monitor your CIBIL and Experian reports every quarter to detect unauthorized guarantee listings.
  • Demand Written Closure Confirmation: The moment the guaranteed loan is settled, obtain an official No Dues Certificate (NDC) from the bank stating that your guarantee has been released in full.

Exercising Statutory Rights under RBI's 2023 Compensation Circular

If an erroneous guarantee listing or un-updated default appears on your credit report:

  1. Lodge an Online Dispute: File an online dispute on the CIBIL (cibil.com) or Experian portal citing the loan account number and attaching the bank's NDC or Deed of Release.
  2. Serve Formal Notice on the Bank: Simultaneously email the Nodal Officer of the reporting bank demanding rectification under RBI Circular DOR.FIN.REC.48/20.16.056/2023-24.
  3. Claim ₹100/Day Statutory Compensation: Under Para 3 of the RBI circular, if the bank or bureau fails to rectify the credit record within 30 calendar days, the bank is legally required to pay you ₹100 per day of delay automatically into your bank account.
  4. Escalate to RBI Ombudsman: If the bank fails to pay the compensation or resolve the dispute after 30 days, file an immediate complaint on the RBI CMS portal (cms.rbi.org.in).

Practitioner's note

In handling credit repair for clients who acted as guarantors, the primary procedural weapon is the RBI Circular on Customer Service and Grievance Redressal in Credit Information Companies (RBI/2023-24/71).

Before this circular, banks routinely ignored CIBIL dispute tickets for months, blaming bureau tech support. Under the current framework, the 30-day resolution window is a strict statutory deadline:

  • Days 1 to 21: The Credit Information Company must forward the dispute to the bank, and the bank must verify and respond.
  • Days 22 to 30: The bureau must update the database and inform the customer.

If the 30th day passes and the guarantee tag remains, draft an immediate formal demand for compensation under Para 3. State the date of the initial dispute ticket, calculate the accrued compensation at ₹100 per day, and demand payment within 7 days. In over 80% of cases, the bank's compliance team accelerates the deletion of the disputed guarantee tag within 48 hours to avoid paying the statutory compensation.

Questions people ask

Does signing as a guarantor reduce my own loan eligibility?

Yes. When you apply for a loan, banks inspect your credit report. Many lenders consider the guaranteed loan as a "contingent liability" and add a portion of the guaranteed EMI to your debt-to-income calculations (FOIR), reducing the maximum loan amount they will sanction for you.

Can a borrower's default ruin my CIBIL score?

Yes. Credit bureaus mirror the repayment behaviour of the loan on both the primary borrower's and the guarantor's credit profiles. If the borrower defaults, your CIBIL score will drop drastically, often by 50 to 150 points.

What should I do if my credit score dropped because of a loan I guaranteed?

Contact the primary borrower immediately to understand the default status. If the borrower cannot pay, you must decide whether to service the missed EMIs to protect your credit profile or negotiate an OTS with the bank. Once the account is settled, demand an immediate update from the bank to credit bureaus.

How long does a defaulted guarantee stay on my CIBIL report?

Adverse credit statuses, including defaults, write-offs, and settlements, remain on your credit bureau history for seven years from the date of reporting, unless the underlying error is corrected or the debt is cleared and marked "Closed".

Can a bank report me as a "Wilful Defaulter" if I am only a guarantor?

Under RBI Master Directions on Wilful Defaulters, a guarantor can be declared a wilful defaulter only if: (1) the bank made a formal demand upon the guarantor, (2) the guarantor has the financial means to pay the debt, and (3) the guarantor intentionally refuses to pay. The bank must issue a formal show-cause notice and provide a hearing before an Identification Committee under the Jah Developers Supreme Court guidelines.

What is the penalty on banks for delaying credit report corrections?

Under RBI Circular RBI/2023-24/71, if a bank or credit bureau fails to resolve your credit dispute and update the credit record within 30 calendar days, the bank is legally obligated to pay you compensation of ₹100 per calendar day for every day of delay beyond 30 days.
