Before you borrow: key disclosures, real costs, and contract traps

The single most critical moment in the life of a loan occurs before you sign the loan agreement. Once an agreement is executed, Indian courts presume that commercial borrowers and literate citizens have understood and agreed to all standard-form terms. However, lenders routinely exploit information asymmetries: advertising an attractive headline interest rate while concealing upfront processing fees, documentation charges, bundled credit life insurance, compounding penal interest, and arbitrary interest rate reset formulas.

Under decisive regulatory directions issued by the Reserve Bank of India, borrowers are no longer at the mercy of opaque contracts. Lenders are legally mandated to provide a standardized, one-page Key Fact Statement (KFS) disclosing the true Annual Percentage Rate (APR)—the all-inclusive annual borrowing cost—before executing any loan. For floating-rate loans, lenders must offer clear choices to switch to fixed rates or extend tenures during rate hikes, and penal interest compounding has been banned nationwide. This section explains how to audit your loan documents, evaluate true borrowing affordability, and identify unenforceable contract terms before funds are disbursed.
